3rd Circuit: Retailer Did Not Willfully Violate Credit Transaction Act

PHILADELPHIA – The Third Circuit U.S. Court of Appeals on Jan. 24 affirmed the ruling that a retailer does not willfully violate the Fair and Accurate Credit Transactions Act (FACTA) by printing the expiration month, but not the year, of the credit card on a receipt (Randy Long, individually and behalf of all others similarly situated v. Tommy Hilfiger Inc., No. 11-1554, 3rd Cir.; 2012 U.S. App. LEXIS 1269).

Credit Card Claims Against Diet Supplement Company Ordered Into Arbitration

HARTFORD, Conn. – Allegations that a diet supplement company violated Connecticut and federal consumer laws by improperly using customers’ credit card information to obtain money to which the company was not entitled were ordered into arbitration on Jan. 9 by a federal magistrate judge (Federal Trade Commission, et al. v. LeanSpa LLC, No. 3:11-CV-1715, D. Conn.).

Court says credit repair groups can force consumers into arbitration

Credit repair organizations can require consumers to arbitrate their claims, the Supreme Court has ruled, rejecting arguments by consumer and senior citizen groups that the federal Credit Repair Organizations Act gives consumers a non-waivable right to go to court with claims of unfair or deceptive practices.
