South Carolina Judge Says Federal Statute Preempts Claims, Dismisses Suit

ANDERSON, S.C. – A South Carolina federal judge on Jan. 25 granted defense motions for dismissal and summary judgment in a case seeking to determine who was responsible for paying medical claims of a now-deceased man, saying that the plaintiff’s claims were preempted by federal statutes (Betty H. Lominick v. Michelin Tire, et al., No. 11-945, D. S.C.; 2012 U.S. Dist. LEXIS 8401).
