Plan Administrator Must Decide Benefits Dispute, New Jersey Federal Judge Rules

CAMDEN, N.J. – A New Jersey federal judge on Jan. 26 denied summary judgment to both a former driver for a bakery company and the company’s insurer in a dispute over long-term disability benefits pursuant to the Employee Retirement Income Security Act and remanded the case to the ERISA plan administrator for a ruling (Stephen Ellsworth v. Harleysville Life Insurance Co., et al., No. 09-2548, D. N.J.; 2012 U.S. Dist. LEXIS 9614).
