Nebraska Supreme Court Upsets Defense Judgment, Remands Crop Loss Case For Retrial

LINCOLN, Neb. – The Nebraska Supreme Court issued an opinion on Jan. 27 in which it applied the economic loss doctrine to a case alleging crop damage from the negligent application of an herbicide to the cornfields of the plaintiffs and remanded to the trial court for retrial (Thomas Lesiak, et al. v. Central Valley Ag Cooperative Inc., No. 10-323, Neb. Sup.; 2012 Neb. LEXIS 12).
