Missouri Federal Judge Allows Expert Testimony In Asbestos Coverage Suit

ST. LOUIS – A Missouri federal judge on Jan. 6 allowed the expert testimony of a medical doctor and an insurance expert in an asbestos coverage dispute after determining that each of the witnesses could provide assistance to the jury’s understanding of the case (Brauer Supply Co. 542(g) Asbestos Personal Injury Trust v. Atlanta International Insurance Co., No. 09-1640, E.D. Mo.; 2012 U.S. Dist. LEXIS 1431). (Opinion available 03-120111-004Z ) Brauer Supply Company 542(g) Asbestos Personal Injury Trust filed suit in the U.S. District Court for the Eastern District of Missouri, seeking a declaration regarding its entitlement to the proceeds of certain insurance policies issued by Atlanta International Insurance Co. for numerous underlying asbestos-related claims.
