July 2012 Visa Bulletin: EB-2 Priority Dates Retrogress to 01/01/09


In the recently published U.S. Department of State Visa Bulletin for July 2012, the EB-2 priority dates has retrogressed and moved back to 01 January, 2009 in respect of all countries other than India and mainland China. EB-2 priority dates for India and China are currently unavailable and it will remain so for the remainder of FY-2012. Meanwhile, the EB-1, EB-4 and EB-5 numbers continue to remain current for all countries.


In the EB-3 category, the priority dates for professionals and skilled workers advanced from 08/08/05 to 09/22/05 in respect of China; from 09/15/02 to 09/22/02 in respect of India; from 05/22/06 to 06/08/06 in respect of Philippines, and from 06/08/06 to 07/22/06 in respect of all other countries.


In the EB-3 Other Workers category, the priority dates advanced from 04/22/03 to 06/15/03 in respect of China, from 09/15/02 to 09/22/02 in respect of India; 05/22/06 to 06/08/06 in respect of Philippines, and from 06/08/06 to 07/22/06 in respect of all other countries.


Retrogression in EB-2 numbers mean that EB-2 beneficiaries from countries other than India and China, who have a priority date of January 01, 2009 or later, will need to file for Adjustment of Status or an Immigrant Visa before June 30, 2012, failing which, they will have to wait till their number comes up again in the visa bulletin before they can file for Adjustment of Status or an Immigrant Visa.
