Judge Remands Wrongful Foreclosure Suit But Only After Dismissing Federal Claim

SACRAMENTO, Calif. – A federal judge in California on Jan. 20 remanded a wrongful foreclosure action to state court, but did so after dismissing the plaintiff’s Fair Credit Reporting Act (FCRA) claim, rather than granting the plaintiff’s motion to remand (Gregory Smith, et al. v. Quality Loan Service Corp., et al., No. S-11-2108 KJM-EFB, E.D. Calif.; 2012 U.S. Dist. LEXIS 7513).
