Judge Reduces Medicaid Lien Sought From $11.78M Mold Settlement

PHILADELPHIA – After taking into consideration the overall uncertainty a tenant faced in prevailing on her claim that unsafe conditions in a home rented through a federally subsidized housing program caused her and her children to suffer injuries and her chances of recovering past medical expenses, a Pennsylvania federal judge on Aug. 24 reduced a Medicaid lien that the Pennsylvania Department of Public Welfare (DPW) sought to recoup from an $11.78 million settlement reached with the tenants (Angelique McKinney, et al. v. Philadelphia Housing Authority, et al., No. 07-4432, E.D. Pa.).
