Judge Denies Judgment On Insurer’s Duty To Defend Defects Lawsuit

SAN DIEGO – A California federal judge on Jan. 25 denied partial summary judgment to two insurers regarding their duty to defend a construction defect action because there is ambiguity to whether an additional insured endorsement applies (McMillin Construction Services L.P. v. Arch Specialty Insurance Co., et al., No. 10-2592, S.D. Calif.; 2012 U.S. Dist. LEXIS 8339).
