Insureds Are Entitled To Fees Against Insurance Guaranty, Panel Holds

WEST PALM BEACH, Fla. – Policyholders were entitled to recover their attorney fees against the Florida Insurance Guaranty Association (FIGA) because FIGA denied their covered claim “by affirmative action,” the Fourth District Florida Court of Appeal ruled Oct. 12 (Alon Rahabi and Sharleen Wertheimer v. Florida Insurance Guaranty Association Inc., No. 4D10-846, Fla. App., 4th Dist.; 2011 Fla. App. LEXIS 16142).
