Federal Judge Refuses To Dismiss Insurer’s Coverage Lawsuit

TULSA, Okla. – A federal judge in Oklahoma on Jan. 24 denied a claimant’s motion to dismiss or stay a commercial general liability insurer’s coverage action regarding damages the claimant as a building tenant sustained following a rainstorm because the claimant’s pending state court lawsuit would not resolve the insurer’s controversy (United Specialty Insurance Co. v. Conner Roofing & Guttering LLC, et al., No. 11-0329, N.D. Okla.; 2012 U.S. Dist. LEXIS 7831).
