Federal Judge Dismisses Tenant’s Warranty Claims In Moldy Apartment Action

OPELIKA, Ala. – An Alabama federal judge on June 27 dismissed a claim for breach of warranty of habitability asserted by a tenant who alleged that her apartment was infested with mold and contained defects, but found that certain claims asserted against the parent company of the complex’s owner could proceed (Charisse D. Allen v. Cypress Village Ltd., et al., No. 3:10-CV-994, M.D. Ala.; 2011 U.S. Dist. LEXIS 68985).
