Federal Judge Denies Motion To Return ATM Fees Case To State Court

TAMPA, Fla. – In a case in which a plaintiff alleges that a supermarket chain charged hidden ATM fees, a federal judge in Florida on Jan. 26 denied the plaintiff’s motion to return the suit to state court, rejecting the argument that the defendant fails to establish that the Class Action Fairness Act (CAFA) applies (Heretick v. Publix Super Markets Inc., No. 11-02438, M.D. Fla.; 2012 U.S. Dist. LEXIS 9465).
