Federal Judge Declines To Dismiss Insurer’s Coverage Lawsuit

MOBILE, Ala. – A federal judge in Alabama on Jan. 24 refused to dismiss a commercial general liability insurer’s coverage action because an actual case or controversy exists as to whether there is coverage for claims of construction defects (Evanston Insurance Co. v. Damon Lett d/b/a Damon Lett Roofing, et al., No. 11-0383, S.D. Ala.; 2012 U.S. Dist. LEXIS 8526).
