Federal Circuit Vacates, Remands Portions Of Dispute Over Blood-Monitoring Patents
WASHINGTON, D.C. – Because a Delaware federal judge did not consider claim construction arguments raised by a patent holder regarding the term electrode, the Federal Circuit vacated a judgment of noninfringement Jan. 25 and remanded for further proceedings (Roche Diagnostic Operations Inc. v. Lifescan Inc. and Nova Biomedical Corporation, Nos. 10-1439, – 1539, Fed. Cir.).
