Federal Circuit Defines Key To Inquiry Under Patent Misuse Doctrine

WASHINGTON, D.C. – Sitting en banc, the Federal Circuit U.S. Court of Appeals on Aug. 30 held that the key inquiry under the patent misuse doctrine is whether the patentee has “leveraged its patent beyond the scope of rights granted by the Patent Act” (Princo Corporation and Princo America Corporation v. International Trade Commission and U.S. Philips Corporation, No. 2007-1386, Fed. Cir.).
