Evidence Does Not Support Disability Finding, Texas Federal Judge Holds

HOUSTON – An ERISA-governed disability insurer that denied benefits to a claimant with anxiety and post-traumatic stress disorder acted reasonably, a Texas federal judge ruled Oct. 4. The judge found that the claimant failed to produce objective medical evidence to support her disability (Veronica Brown v. Metropolitan Life Insurance Co., et al., No. 11-840, S.D. Texas; 2011 U.S. Dist. LEXIS 114197).
