Claims Against Real Estate Sites Dismissed As Precluded By ‘Terms And Conditions’

FLORENCE, S.C. – A property owner’s contract and unfair claims complaint over property listing errors allegedly made by several vacation rental listing websites failed because the sites’ respective “terms and conditions” disclaimed responsibility for the accuracy of the listings, a South Carolina federal judge ruled Jan. 24, granting summary judgment in favor of the sites’ operators (Kraft Real Estate Investments LLC, et al. v. Homeaway.com Inc., No. 4:08-cv-03788, D. S.C.; 2012 U.S. Dist. LEXIS 8282).
