California Panel: Hirer Cannot Be Held Responsible For Man’s Workplace Injury

SAN FRANCISCO – A California appeals panel on Nov. 8 affirmed summary judgment for a construction company owner named as the defendant in a workplace accident case, concluding that the trial court properly ruled that the defendant could not be held liable as a hirer for failing to provide safety equipment on the worksite (Charles DeFrates v. Robert Clark, No. A131222, Calif. App., 1st Dist.; 2011 Cal. App. Unpub. LEXIS 8552).
