Bankruptcy Judge: Debtor’s Chapter 13 Plan May Have Duration Less Than 5 Years

PEORIA, Ill. – A federal bankruptcy judge in Illinois on Aug. 2 confirmed a debtor’s Chapter 13 payment plan on grounds that it was not required to have a five-year duration because the debtor had no disposable income (In Re: Robert C. Andres, No. 10-92563, Chapter 13, C.D. Ill. Bkcy.; 2011 Bankr. LEXIS 2868).
