Additional Insured Owed A Defense For Property Damage, Judge Concludes

SAN DIEGO – An insurance company had a duty to defend under two insurance policies allegations of property damage caused by an insured subcontractor’s grading work, a California federal judge ruled Jan. 5, granting summary judgment to the additional insured contractor (D.R. Horton Los Angeles Holding Co. Inc. v. American Safety Indemnity Co., No. 10-443, S.D. Calif.; 2012 U.S. Dist. LEXIS 1881).
