8th Circuit Affirms Ruling In Insurers’ Favor In Cedar River Flood Coverage Suit

ST. PAUL, Minn. – The Eighth Circuit U.S. Court of Appeals on Nov. 29 affirmed a lower court’s ruling in favor of insurers on an insured’s breach of contract and bad faith lawsuit alleging that the insurers owed additional coverage for business interruption and debris removal arising from the Cedar River flood (Penford Corporation, et al. v. National Union Fire Insurance Company of Pittsburgh, PA, et al., No. 10-3068, 8th Cir.; 2011 U.S. App. LEXIS 23734).
