6th Circuit: BAPCPA Imposes Minimum Duration For Chapter 13 Payment Plans

CINCINNATI – A panel of the Sixth Circuit U.S. Court of Appeals on Feb. 4 ruled that the Bankruptcy Code imposes a minimum duration for Chapter 13 payment plans regardless of a debtor’s projected disposable income (Richard L. Baud, et al. v. Krispen S. Carroll, No. 09-2164, Chapter 13, 6th Cir.; 2011 U.S. App. LEXIS 2182).
