5th Circuit: Trustee May Recover Transfers; Property Belongs To Bankruptcy Estate
NEW ORLEANS – A panel of the Fifth Circuit U.S. Court of Appeals on Jan. 12 ruled that a trustee could recover payments made by a debtor couple to investors in their business because the money properly belonged to the bankruptcy estate (Warren Waite Jr., et al. v. Lowell T. Cage [In Re: Marvin Moye, et al.], No. 11-20437, Chapter 11, 5th Cir.; 2012 U.S. App. LEXIS 772).
