5th Circuit: Loan Servicer Did Not Breach Duty By Paying Delinquent Taxes

NEW ORLEANS – A Fifth Circuit U.S. Court of Appeals panel on Dec. 5 found no error in a federal judge in Texas’ ruling dismissing a man’s lawsuit against his loan servicer over its payment of delinquent property taxes, establishment of an escrow account to cover the taxes and foreclosure on the property after the plaintiff defaulted on his loan (Bobie Kenneth Townsend v. BAC Home Loans Servicing LP, No. 11-20319, 5th Cir.).
