11th Circuit Reverses; Duration Of Bankruptcy Plan Fixed By Code

ATLANTA – A panel of the 11th Circuit U.S. Court of Appeals on July 16 reversed and remanded a bankruptcy court’s ruling, concluding that the “applicable commitment period” detailed in the Bankruptcy Code is a fixed time period that the debtor in the matter at hand did not honor (Nancy J. Whaley v. Terry Alan Tennyson [In Re: Terry Alan Tennyson], No. 09-14628, Chapter 13, 11th Cir.; 2010 U.S. App. LEXIS 14638).
